In most cases, you should be prepared to retain a defense attorney prior to the arraignment to ensure that all necessary paperwork is obtained from the government and your rights are protected from the onset of your criminal case. In more serious cases, or if you are already on probation for an open case, you should absolutely be represented by an attorney at the arraignment as the prosecution is likely to ask that you either be held on bail, have the bail revoked on your open case and have you detained for up to 90 days, or have you held as a "dangerous person" for up to 120 days. In this situation, if you're convinced that you can't afford an attorney, you're doing yourself a major injustice. The truth is, you can't afford NOT to have an attorney.
